LemonInspect Disclaimer — Service Limitations and Notice of Liability

Important Notice: Please be sure to read this Disclaimer carefully before purchasing or using a report. By completing a purchase, the Member confirms that the Member has read, understood, and agreed to this Disclaimer in its entirety.

Article 1 (General Disclaimer)

1.1. All reports, scores, assessments, and data (collectively, “Reports”) provided by TSBT Company Co.,Ltd. (hereinafter the “Company”) through its website, application, or other media are provided solely for general reference information purposes.

1.2. Reports are not a substitute for professional physical vehicle inspection, certified mechanical assessment, legal advice, financial advice, or any other form of professional consultation.

1.3. The Company is a technology company that provides data aggregation and AI-assisted analysis services. The Company is not a vehicle dealer, broker, inspector, appraiser, insurer, or financial advisor.

1.4. Notice that statutory inspection documents cannot be replaced. LemonInspect Reports do not replace any vehicle inspection or certification documents required by the government. This includes, but is not limited to, the following:

  • Motor Vehicle Performance and Condition Inspection Record under Article 58 of the Motor Vehicle Management Act
  • Vehicle safety inspection certificates required within the user’s jurisdiction
  • Official vehicle certification or roadworthiness documents required for vehicle registration, import, or export

Dealers, traders, and other commercial users bear full responsibility for complying with all inspection and documentation requirements applicable in their jurisdictions.

Article 2 (Limitations of AI-Based Inspection Assistance)

The Company’s LemonInspect inspection assistance engine uses artificial intelligence and machine learning algorithms to analyze vehicle data. Users must understand the following inherent limitations:

The function-specific limitation notices in this Article apply where the relevant function is actually provided through a beta, pilot, official release, or separate contract or payment screen.

2.1. Engine Sound Diagnosis (Sound Analysis — Core B, Beta)

  • AI-based engine sound, transmission, and mechanical sound analysis is an approximation based on pattern recognition.
  • Environmental noise, recording quality, microphone specifications, and surrounding conditions may significantly affect diagnostic accuracy.
  • Engine sound diagnosis cannot detect defects that do not produce auditory symptoms — such as internal component wear, hidden fluid leaks, and electrical failures.
  • Sound-to-Cost analysis, which predicts time to failure (MTBF) and repair costs from sound types, is a statistical estimate based on the Company’s repair history data, and the actual time of failure varies depending on driving habits and maintenance history.

2.2. Visual/Image Diagnosis (Vision AI — Core C, When the Relevant Function Is Provided)

  • AI-based photo and video analysis relies on image recognition models trained on finite datasets.
  • Image resolution, lighting conditions, camera angle, and surface contamination (dust, rust-prevention coating) may affect the accuracy of visual assessment.
  • Visual diagnosis cannot identify damage beneath the surface, structural deformation hidden behind panels, repainted or cosmetically repaired areas, or defects below the resolution threshold of the submitted media.
  • In particular, light-source reflection (Glare) may be confused with actual scratches, and the Company applies Chain of Thought determination logic to distinguish between them, but does not guarantee 100% accuracy.

2.3. Trust Score and Reliability Rating

  • The LemonInspect Trust Score is a synthetic algorithmic estimate that integrates available data collected from multiple analysis modules.
  • The Trust Score is not a warranty, certification, guarantee, or official appraisal of the vehicle’s condition, value, or safety.
  • The Trust Score may change if new data is obtained or the underlying algorithm is updated.

2.4. Repair Cost Prediction

  • All repair cost figures presented in the Report are algorithmic estimates based on publicly available parts price data, purchasing power parity (PPP) indices, and regional labor cost models.
  • Actual repair costs at a specific repair shop, workshop, or official service center may differ substantially from the provided estimates.
  • The Company does not compensate for differences between estimated repair costs and actual repair costs.
  • Secondary damage cost predictions (“Cascade Failure” estimates) represent worst-case scenarios based on historical failure mode analysis and are not definitive predictions.

2.5. Recall and Safety Data

  • Recall and safety information is collected from government agencies (e.g., NHTSA, the Ministry of Land, Infrastructure and Transport/Korea Automobile Testing & Research Institute (KATRI), Euro NCAP) and other public databases.
  • The Company does not independently verify whether recall repairs for a particular vehicle have been completed.
  • The absence of recall data in a Report does not mean that the vehicle has no recall or safety defects.

2.6. OBD-II Diagnostic Data (When the Relevant Function Is Provided)

  • OBD-II-based diagnostic trouble code (DTC) analysis interprets standard codes reported by the vehicle ECU.
  • DTCs may be intentionally cleared by a dealer or previous owner, and the Company detects suspected clearing through Readiness Monitor analysis, but 100% determination is not possible.
  • Not all vehicles support the full range of OBD-II PIDs, and data availability varies depending on the vehicle manufacturer, model year, and ECU specifications.
  • Permanent DTCs (Permanent DTC, Mode 0A) remaining after clearing are included where available, but they are not universally supported by all ECUs.

2.7. Warranty Risk Pricing (When the Relevant Function Is Provided)

  • The Warranty Risk Pricer generates actuarial reference estimates derived from NHTSA complaint data, repair cost databases, and parts availability indices.
  • These figures are reference intelligence only and are not insurance quotes, warranty offers, or binding prices.
  • Actual warranty pricing must comprehensively consider market conditions, acquisition cost, competitive analysis, and professional actuarial assessment.

2.8. Third-Party Record Manipulation and Fraud

  • The Company relies on data reported by third-party sources and public registries. If VIN, title, mileage (odometer) records, accident history, or ownership history is forged, altered, duplicated, or manipulated by a third party (including, but not limited to, sellers, dealers, auction houses, export brokers, and previous owners), the Company cannot guarantee that it will detect such manipulation and does not assume any duty to detect it.
  • Common types of fraud in the used-car market include, but are not limited to, the following:
  • VIN cloning — replacing the VIN of a stolen or total-loss vehicle with the VIN of a legitimate vehicle
  • Odometer manipulation (odometer rollback) — manipulating the dashboard mileage to display a lower mileage than the actual mileage
  • Title Washing — transferring vehicle registration between jurisdictions to remove “total loss,” “flood,” or “scrapped” history from title records
  • Concealment of exterior accident damage — concealing structural collision damage through professional bodywork and painting
  • The Company assumes no liability for any losses, damages, or costs arising from reliance on a Report affected by such third-party fraud or record manipulation.
  • This Report does not replace physical vehicle inspection, title verification through the relevant government registry, or verification of the authenticity of the VIN plate.

2.9. Report Reference Date, Version Reuse, and Validity

  • A Report reflects the data available as of the report reference date indicated in the Report. Vehicle condition, history records, title, mileage, registration status, source data records, and market value may change after that reference date.
  • For cost control and to prevent duplicate issuance, the Company may reuse the latest Report version for the same VIN for up to 30 days (thirty days). A user who purchases a Report during this period may receive a Report with a reference date earlier than the user’s viewing date.
  • Report viewing and PDF download access granted to a Member is provided, by plan, for 6 months (180 days) from the date access is granted for a Single Report, and for 1 year (365 days) from the date access is granted for a Multi-Check Pack and Dealer Starter Pack. This period is only the period of access and is not a period that guarantees the up-to-dateness of information or the vehicle condition after the report reference date.
  • Where the report reference date and access conditions have been notified, a reused Report is a valid digital output. Such Report shall not be deemed a defective output solely because it was generated before the user’s viewing date.
  • The Company does not guarantee accuracy or relevance after the report reference date. Reports that are more than 90 days old as of the transaction date should be used with appropriate caution, and purchase of an updated Report is recommended.
  • LemonInspect Reports are not certificates, warranties, or permanent proof of vehicle quality. They are data snapshots at a particular point in time.

2.10. Unconfirmed or Unresolved Items

  • Some source data may be displayed as pending, unconfirmed, unresolved, or not finally reflected by the relevant source provider.
  • The Company does not guarantee that unconfirmed items will be resolved, confirmed, corrected, or changed in the future.
  • Where the Company provides free corrective access results for unconfirmed items, this only means that access to a subsequent Report version is provided in accordance with the applicable policy. Unconfirmed items may remain in the subsequent Report, or the contents may be the same as the existing Report.
  • Free corrective access is premised on not being real-time or continuous monitoring, and does not mean an unlimited right to updates or a guarantee of changed or improved results.

Article 3 (Limitations of Third-Party Data)

3.1. Reports are compiled from data obtained from multiple independent third-party sources, such as government vehicle administration agencies, insurance claim databases, auction records, law enforcement reports, manufacturer databases, and commercial data aggregators.

3.2. The Company has no control over the accuracy, completeness, timeliness, or availability of third-party data. Data may be delayed, incomplete, or erroneous at the source.

3.3. Data availability varies significantly depending on the following:

  • Country of vehicle registration or operation
  • Manufacturer and model year
  • Registration jurisdiction and local data reporting requirements
  • Time period — older vehicles or vehicles in jurisdictions with limited digital record management may have insufficient history records

3.4. The absence of a specific data point (e.g., accident history, ownership history, mileage records) in a Report does not indicate that the relevant event did not occur. It only indicates that the relevant data was not available to the Company at the time the Report was generated.

Article 4 (No Data — “No-Accident” or “Empty” Reports)

4.1. In certain cases, a Report may contain limited data or no history data for a given VIN. This may occur for the following reasons:

  • The vehicle actually has a clean history with no reportable events
  • Data sources have no records for the vehicle
  • The vehicle is registered in a jurisdiction with limited data coverage
  • The vehicle is too new for meaningful history to have accumulated

4.2. A Report with limited or no data is a valid output reflecting the actual state of available information. It is not a defective or incomplete product.

4.3. A “no-findings” Report is not a certificate that the vehicle is free of defects. It merely means that no negative data was found from the queried sources.

Article 5 (User Responsibility)

5.1. The decision to purchase, sell, finance, insure, import, export, or otherwise transact in a vehicle is solely the Member’s responsibility. The Member must not rely exclusively on a LemonInspect Report in making such decisions.

5.2. The Company strongly recommends the following:

  • Obtain an independent physical inspection by a qualified and certified mechanic
  • Directly verify the vehicle history through official government registries
  • Consult qualified professionals (mechanics, appraisers, lawyers) where appropriate
  • Conduct a test drive and direct visual inspection before the transaction

5.3. By purchasing a Report, the Member expressly acknowledges and agrees to the following:

  • The Member will not rely solely and exclusively on the Report in making transaction decisions
  • AI-based reference analysis is probabilistic, not definitive — it indicates likelihood, not certainty
  • The Company assumes no liability for any losses, damages, or costs arising from decisions based on the Report

Article 6 (Limitation of Liability)

6.1. To the fullest extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising in connection with the following:

  • (a) use of or reliance on a Report, Trust Score, or other information provided through the service;
  • (b) inaccuracies, incompleteness, or errors in a Report or data;
  • (c) purchase, sale, or other transaction decisions regarding a vehicle;
  • (d) delays or failures in service provision due to third-party API unavailability or system failures;
  • (e) differences between estimated repair costs and actual repair costs, vehicle value, or other financial figures.

6.2. The limit of the Company’s liability shall be governed by the limitation of liability in Article 9.2 of the Terms of Use. For claims related to an individual Report, the Company’s liability shall be limited to the amount paid by the Member for the relevant Report, and in no event shall exceed the aggregate cumulative limit under Article 9.2 of the Terms of Use.

6.3. However, the limitation of liability in this Article shall not apply to (i) damages caused by the Company’s willful misconduct or gross negligence, (ii) personal injury to life or body, or (iii) liabilities that a business operator cannot limit or exempt under applicable laws, including the Act on the Regulation of Terms and Conditions.

Article 7 (Pre-Purchase Consent — Confirmation at Payment)

Before completing a purchase on the LemonInspect platform, the Member will be asked to actively confirm the following statement:

☑ “LemonInspect provides vehicle history and risk information based on available data sources. LemonInspect does not guarantee the vehicle’s physical condition, accident-free status, market value, or future performance. I understand that, after generation of this Report begins, withdrawal of the purchase is in principle restricted under the “Refund and Cancellation Policy” (excluding causes attributable to the Company and mandatory refund rights under applicable laws), and I accept the limitations described in this Disclaimer.”

This confirmation is a mandatory condition for all purchases. The Member’s express consent is recorded and may be presented as evidence in the event of a payment dispute.

Article 8 (B2B Partners and Insurance Disclaimer)

8.1. Where LemonInspect data, Trust Score, or diagnostic results are integrated or referenced by a third-party platform, insurance product, warranty service provider, auction house, or vehicle management system (collectively, “B2B Partner”):

  • The Company acts purely as a data and analytics provider. The Company does not underwrite, co-underwrite, guarantee, or assume any responsibility for the products, services, pricing decisions, or coverage decisions of B2B Partners.
  • B2B Partners bear full responsibility for their own independent assessments, decision-making, and regulatory compliance.
  • Any warranty, insurance product, or financial product provided by a B2B Partner using LemonInspect data is the sole obligation of that B2B Partner. The Company shall not be designated as a co-insurer, guarantor, or indemnitor in any B2B Partner contract.

8.2. Disclaimer of agency relationship. Nothing in this Disclaimer or any LemonInspect Report creates a joint venture, partnership, agency, or employment relationship between the Company and a B2B Partner.

Article 9 (Governing Law and Language Priority)

9.1. Governing Law. This Disclaimer shall be governed by and construed in accordance with the laws of the Republic of Korea. This Disclaimer constitutes part of and supplements the Terms of Use. In the event of a conflict between this Disclaimer and the Terms of Use, the Terms of Use shall prevail. Where mandatory laws related to consumer protection apply, such laws shall prevail over these documents.

9.2. Language Priority. The Korean version of this Disclaimer is the authoritative version, and versions translated into English or other languages are provided for the Member’s convenience. In the event of any difference in interpretation between the authoritative version and a translation, the Korean authoritative version shall prevail.
